To adopt your stepchild in Idaho, you file a petition for adoption with the Magistrate Court in your county, include the required consents (or a petition to terminate the other parent's rights), and complete the court process, which typically takes 3-6 months. Idaho's stepparent adoption rules are found in Idaho Code Title 16, Chapter 15, and you can do this without hiring an attorney.

The court. Your case is filed in the Magistrate Court in the Idaho county where you live. Idaho has 44 counties, and each clerk's office can tell you about local forms, filing steps and scheduling.

What you typically file.

  • A petition for adoption
  • Consent forms from the people whose consent is needed, or a termination petition if a consent won't be given
  • Your spouse's consent to the adoption
  • The court filing fee, typically $150-$250

Consent. Idaho allows a parent's consent to be signed any time after the child's birth. A child who is 12 has a consent role in the process under Idaho Code § 16-1504. Whose consent is required in your exact situation depends on your family's facts, so confirm the details with the clerk or an attorney.

If the other parent won't consent. Termination of parental rights is handled as a separate petition in Idaho. Idaho's abandonment period is 12 months under Idaho Code § 16-2005. Whether that applies to your family depends on specific facts, such as contact and support history. A contested case or one involving an unknown parent is a good time to ask the Magistrate Court clerk or an attorney about your situation.

Notice to the other parent. Idaho allows personal service by a sheriff or process server. If the other parent's location is unknown, service by publication is allowed.

Residency. Idaho has a residency period of 6 months under Idaho Code § 16-1506(1). The clerk can confirm how it applies to your family.

Home study. Idaho waives the home study for stepparent adoptions under Idaho Code § 16-1506. That removes a step that can add time and expense in other kinds of adoption.

Timeline. A stepparent adoption usually takes 3-6 months from filing to finalization. A contested case or a delay in locating a parent can change that.

Cost. Court filing fees typically run $150-$250, and the total cost of a do-it-yourself stepparent adoption is typically under $1,000. Hiring an attorney commonly costs $3,000-$5,000 or more.

After the adoption. Once the court finalizes the adoption, the Idaho Bureau of Vital Records and Health Statistics is the agency that handles birth record questions. The clerk can explain how to request updated records.

A few practical tips.

  • Call the Magistrate Court clerk in your county before you file to ask about local requirements.
  • Gather your marriage certificate, your stepchild's birth certificate, and
