In Montana, you adopt your stepchild by filing a petition with the District Court in your county, getting the required consents, and attending the court process until a judge approves the adoption. Stepparent adoptions in Montana typically take about 3-6 months.
Where you file. Stepparent adoptions are handled by the District Court. Montana has 56 counties, and the District Court clerk in your county (in places like Billings, Missoula, Great Falls, Bozeman or Butte, for example) can confirm local filing procedures and the current filing fee.
Residency. Montana has no minimum residency period for this kind of adoption (Mont. Code Ann. § 42-1-104(1)). You do not have to wait a set number of months after moving to the state before you file.
Consent. Consent is a central part of any stepparent adoption:
- Your stepchild's own consent is part of the process if the child is 12 or older (Mont. Code Ann. § 42-2-301).
- Whether the other biological parent must consent, and what happens if that parent cannot be found or does not agree, depends on your family's facts. Please raise that with the District Court clerk or an attorney.
- Montana refers to a six-month abandonment period (Mont. Code Ann. § 42-2-608). Whether it applies to your situation is a fact-specific question for an attorney.
Home study. Montana waives the home study in this type of adoption (Mont. Code Ann. § 42-4-309). You should not need to schedule a social worker's evaluation of your home, but ask the clerk whether your court requires anything else.
Timeline. Plan on roughly 3-6 months from filing to a finished adoption. Your court's calendar and how smoothly the consents go will affect the exact timing.
After the adoption. The Montana Office of Vital Statistics is the agency to ask about your child's birth record once the adoption is final.
What to expect in general. The basic path looks like this:
- Gather the information about you, your spouse, your stepchild and the other parent.
- Complete the petition and consent forms that your county's District Court expects.
- File with the clerk and pay the filing fee.
- Attend any hearing the court schedules.
- Receive the court's decree.
Contested or unclear situations. If the other parent objects, cannot be located, or your family's situation is unusual, talk to the District Court clerk about procedure and to a Montana family law attorney about your specific case.
