What are the requirements for stepparent adoption in Montana?

Residency: Montana sets no minimum length of time you must have lived in the state before filing (Mont. Code Ann. § 42-1-104(1)).

Your child's consent: A child who is 12 or older must consent to the adoption (Mont. Code Ann. § 42-2-301). For younger children, there is no child-consent requirement based on age.

The other parent: This is the piece that most often shapes a stepparent adoption. The question is whether the child's other parent agrees to the adoption or whether the abandonment provision applies. Montana's abandonment provision uses a six-month period (Mont. Code Ann. § 42-2-608). Whether your situation meets it depends on your specific facts.
