How old do you have to be to adopt in Idaho?

3 min readHelping families since 2001Idaho

In Idaho there is no single fixed minimum age to adopt. You must be an adult, and you must be at least 15 years older than the child you are adopting or at least 25 years old (Idaho Code § 16-1502 and Idaho Code § 16-1501). If you are a stepparent, the age rule is much less of a concern.

Stepparents are treated differently. Neither the 15-year gap nor the age-25 rule applies when the adopter is the spouse of one of the child's natural parents. If you are married to the child's mother or father, your age compared with the child's does not stand in the way of a stepparent adoption.

How the rule works for other adopters. Someone who is not married to a natural parent generally needs to clear one of two bars:

  • Be at least 15 years older than the person being adopted, or
  • Be at least 25 years old.

Adult adoptions. Idaho allows an adult to be adopted. The adopter must be a resident adult who has either stood in the role of parent for more than one year while the adoptee was a minor, or who has built a substantial family relationship that the court finds after investigation. The age-gap rules do not apply when an adult's adopter shows a substantial parental relationship maintained for more than one year. Adult adoptions go to the district court in the county where the petitioner lives, and our typical timeline is 4-8 weeks.

Other Idaho requirements that matter alongside age. Meeting the age rule is only one piece. For a stepparent adoption of a child, you should also know:

  • Court: Your petition is filed in the Magistrate Court in your county. Idaho has 44 counties, and the clerk can tell you about local filing details.
  • Residency: Idaho Code § 16-1506(1) calls for six months of residency.
  • Child's consent: A child who is 12 or older must consent (Idaho Code § 16-1504).
  • Other parent's rights: The other legal parent must usually consent, or their rights must be ended through a separate termination petition. Where abandonment is the basis, Idaho Code § 16-2005 refers to 12 months.
  • Home study: Idaho waives the home study for stepparent adoptions (Idaho Code § 16-1506).
  • Timeline and cost: Stepparent adoptions typically take 3-6 months. Court filing fees generally run $150-$250, and the total is typically under $1,000, compared with $3,000-$5,000+ with an attorney.

When your situation is less straightforward. If the other parent is unknown, refuses to consent, or you are unsure how the court will view your circumstances, ask the Magistrate Court clerk in your county or an attorney about that specific issue. The same applies to any age question beyond what is described here.
