Stepparent adoption in Idaho typically takes about 3-6 months from the time you file your petition in Magistrate Court to the finalization hearing. Adult adoptions (18 and older) are usually faster, at about 4-8 weeks. Your exact timing depends on your county's court schedule and on whether the other parent consents.
How the process usually unfolds
- Prepare your paperwork. You need a Petition for Adoption, consent forms (or a termination petition if a parent is not consenting), your spouse's consent to the adoption, and the filing fee. Idaho allows a parent's consent to be signed any time after the child's birth.
- File with your county's Magistrate Court. Idaho has 44 counties, and each has its own clerk's office. Filing fees typically run $150-$250, so ask your clerk for the current amount.
- Notify the other parent. Idaho allows personal service by a sheriff or process server, or service by publication if the parent's location is unknown. Service can add time, especially when a parent is hard to find.
- Wait for the court to process the case. This is the bulk of the 3-6 months. The home study is waived for stepparent adoptions in Idaho (Idaho Code § 16-1506), which keeps the timeline shorter.
- Attend the finalization hearing. The judge approves the adoption. Many families find it feels more like a celebration than a formal proceeding.
Things that can affect your timing
- Residency. Idaho sets a residency period of 6 months (Idaho Code § 16-1506(1)). Confirm with the clerk how it applies to your family before you file.
- Child's consent. A child who is 12 or older must consent to the adoption (Idaho Code § 16-1504), so plan for that paperwork if it applies to you.
- If the other parent won't consent. Termination of parental rights is handled separately from the adoption itself. One ground Idaho recognizes is abandonment, with a 12-month period (Idaho Code § 16-2005). Contested or unknown-parent situations depend heavily on the facts and can take longer than the typical range, so speak with the Magistrate Court clerk or an attorney about your specific case.
- Birth records. For questions about updating a birth record after the adoption, the Idaho Bureau of Vital Records and Health Statistics is the agency to ask.
What it costs
Families who handle the filing themselves typically spend under $1,000 in total, compared with $3,000-$5,000+ for attorney-handled adoptions.
