What is the timeline for adopting my stepchild in Washington?

In Washington, a stepparent adoption typically takes about 3-6 months, and the exact pace depends on your county's Superior Court and on whether the other parent consents.

How the process usually unfolds

  • Prepare your paperwork. You complete the petition and supporting documents for your county. Washington has 39 counties, and each Superior Court may have its own local practices.
  • File with the Superior Court. You file in your county's Superior Court. Filing fees typically run $200-$500, and your clerk can confirm the current amount.
  • Notice and consent. The people whose consent is required must be notified or must consent. This step can lengthen or shorten your timeline more than any other.
  • Background check and home study. Washington requires criminal background checks for adoptive parents. Home study requirements appear in RCW 26.33.220. Washington allows courts to waive the home study in some stepparent adoptions, so ask the clerk whether that could apply to you.
  • Finalization hearing. A judge reviews your case and, if everything is in order, approves the adoption. Many families find this the most joyful part.

Things that affect your timeline

  • Residency: Washington sets no minimum residency period (RCW 26.33.030), so you don't have to wait before filing.
  • Your child's consent: A child who is 14 or older must consent (RCW § 26.33.160). Having that consent ready avoids delays.
  • The other parent: If the other parent agrees, the process is generally more straightforward. If they haven't been involved, Washington sets no fixed number of months for abandonment. It depends on the parent's overall conduct (RCW § 26.33.120). Whether abandonment applies to your situation is a fact-specific question, so check with the Superior Court clerk or an attorney. A contested case can take longer than the typical range.

If you're adopting an adult

Adult adoption (18 or older) usually moves faster, at about 4-8 weeks.
