Do I need the biological father's consent for stepparent adoption in Washington?

Not always. In Washington, a biological father's consent is the simplest route, but if he has abandoned the child, the court can approve a stepparent adoption without it under RCW § 26.33.120.

How consent works. Washington law ties parental consent to adoptees under 18 (RCW 26.33.160(1)(b)). If the father is willing, he can sign a consent. The court schedules a hearing and gives notice to everyone whose consent is required, unless they waive it in writing (RCW 26.33.240). A signed consent usually makes the process more straightforward.

If he hasn't been involved. Washington sets no fixed number of months for abandonment. The court looks at the parent's overall conduct. Some points that apply here:

  • Years without involvement typically support an abandonment finding.
  • Sporadic child support doesn't prevent that finding if he hasn't kept up meaningful contact with the child. Courts look at the whole relationship, not only money.
  • Washington does not treat termination as a separate process (terminationSeparate is false), so the issue is addressed within the adoption case.

The child's own consent. If the child is 14 or older, the child's consent is also required (RCW § 26.33.160).

Where it gets fact-specific. Whether abandonment is proven in your situation depends on your family's history. If the father objects, or if you don't know who or where he is, the outcome turns on those facts. Talk to the Superior Court clerk in your county or an attorney about that specific issue. The clerk can also confirm local filing procedures.

What to expect.

  • Court: You file in the Superior Court of your county.
  • Timeline: A stepparent adoption in Washington typically takes about 3-6 months.
  • Filing fees: Court filing fees generally run $200-$500, and the total cost is typically under $1,000. Attorney-handled adoptions commonly cost $3,000-$5,000 or more.
  • Home study: Home study requirements are covered by RCW 26.33.220, and the clerk can tell you how they apply to your family.
