Are there any special requirements for adoption in Idaho?

Yes. Idaho stepparent adoptions go through the Magistrate Court in your county, and a few state-specific requirements apply on top of the usual paperwork. The rules sit mainly in Idaho Code Title 16, Chapter 15.

What your filing includes. A typical Idaho stepparent adoption involves:

• A Petition for Adoption
• Either consent forms from the other legal parent or a petition to terminate that parent's rights
• Your spouse's consent to the adoption
• The court filing fee, typically $150-$250

Residency. You need to meet Idaho's 6-month residency requirement (Idaho Code § 16-1506(1)).

Your child's consent. If your child is 12 or older, their consent is required (Idaho Code § 16-1504).

Consent from the other parent. Idaho allows this consent to be signed at any time after the child's birth. If the other parent will not consent, termination of their rights is handled as a separate step. One ground for that is abandonment, and Idaho's abandonment period is 12 months (Idaho Code § 16-2005). Whether abandonment applies to your family depends on your facts. If the other parent is unknown, contested, or refusing, ask the Magistrate Court clerk in your county or an attorney about your specific situation.

Home study. Idaho waives the home study for stepparent adoptions (Idaho Code § 16-1506), so you generally don't have to schedule one as a separate hurdle.

Notice to the other parent. When the other parent has to be formally notified, Idaho allows:

• Personal service by a sheriff or process server
• Service by publication if the parent's location is unknown
