How do I adopt my stepson or stepdaughter in Oregon?

You adopt your stepchild in Oregon by filing a stepparent adoption petition in the Circuit Court in your county, getting the required consents (or asking the court to waive them), and completing service and the court's final steps. The process typically takes about 3-6 months.

The basic steps

  • Confirm you can file. Oregon requires six months of residency (ORS § 109.276(2)). Oregon also allows registered domestic partners to adopt their partner's child through the stepparent adoption process.
  • Prepare your paperwork. You'll need a Petition for Adoption, consent forms (or a motion to waive consent), your spouse's consent to the adoption, and the filing fee.
  • File with the Circuit Court. Oregon has 36 counties, and each one's Circuit Court clerk can tell you about local filing details.
  • Handle notice to the other parent. Oregon allows personal service. If the other parent's location is unknown, service by publication is allowed after a diligent search.
  • Complete the final steps. The court finishes the case and issues the adoption decree.

Oregon allows parents to consent before or after filing, and consent may be withdrawn within certain periods. The clerk can confirm how those periods work in your case. The child's consent age is 14 (ORS § 109.328), so if your stepchild is 14 or older, the child's own consent is part of the picture.

Oregon's abandonment period is 12 months (ORS § 109.324). Whether it applies to your family depends on your specific facts, and contested cases are very fact-dependent. For that issue, talk with the Circuit Court clerk or an attorney.

Home study

A home study is waived in Oregon stepparent adoptions (ORS § 109.276(7)(b); § 109.276(8)(a)(B)(ii)), which removes a step that can slow things down elsewhere.

Cost

Court filing fees in Oregon typically run $200-$350, and the total typical cost of a do-it-yourself stepparent adoption is under $1,000. Hiring an attorney commonly costs $3,000-$5,000+.

If your stepchild is an adult

A stepchild who is 18 or older follows a different, shorter process under ORS 109.329. The person being adopted gives written consent, birth parents do not consent, and the timeline is typically 4-8 weeks.

After the adoption

The Oregon Center for Health Statistics is the state's vital records agency. Ask the Circuit Court clerk how to request updated records once your decree is issued.

Good to know

The rules are found in Oregon Revised Statutes Chapter 109. Questions about your own situation, such as an unknown parent or a parent who objects, are best confirmed with the Circuit Court clerk in your county or with an attorney.
