Grandparent adoption is different from stepparent adoption, but it is absolutely possible in Oregon.

Key distinction:

  • Stepparent adoption requires marriage to the child's biological parent and terminates only the OTHER parent's rights
  • Grandparent adoption typically requires termination (or death/consent) of both biological parents' rights

When grandparent adoption applies:

  • Both biological parents are absent, deceased, or consenting
  • You have been the child's primary caretaker
  • You want permanent legal custody with full parental rights

Requirements in Oregon:

  • Petition filed in Circuit Court
  • Background check required
  • Home study is typically required (even in states that waive it for stepparents)
  • The child's best interest is the primary consideration
  • 6 months residency

If you are married to the child's biological parent:

Then you ARE a stepparent, and standard stepparent adoption applies — simpler process, often no home study, and Oregon waives the home study for stepparents.

Cost: Same $349 document preparation fee

Timeline: May be longer than stepparent adoption due to additional requirements
