What if the biological parent sends a gift but has no other contact — is that abandonment in Idaho?

3 min readHelping families since 2001Idaho

A gift on its own does not automatically settle the question in Idaho. Whether it counts as abandonment depends on your facts, and the Magistrate Court decides. Idaho's abandonment period is 12 months under Idaho Code § 16-2005, so that statute is the place to start.

What the statute gives us. Idaho Code § 16-2005 is the abandonment provision, and it uses a 12-month period. The data we work from does not spell out whether a single gift, card or payment interrupts that period, or how a judge weighs that kind of contact against the rest of the parent's involvement. Please don't assume either way. The Magistrate Court clerk in your county can tell you how the court handles it, and an attorney can advise on your specific situation.

Why the details matter. Two families can both say "there was a gift but nothing else" and have different facts. These are the kinds of things worth writing down:

  • The date of the gift and what it was
  • Whether it came with any message to the child, or was sent to you instead
  • Any calls, visits, texts or letters during the same period, even small ones
  • Any attempts you made to keep the biological parent informed or involved
  • The last time before the gift that the parent had contact with the child

A clear, dated timeline is useful whatever the court ultimately decides.

Abandonment is not the only path. In Idaho, a stepparent adoption needs either consent forms or a termination petition, along with the petition for adoption and your spouse's consent. Termination of parental rights is handled separately from the adoption itself. If the biological parent is willing to sign consent, which Idaho allows at any time after birth, you may not need to prove abandonment at all. A parent who stays in light touch by sending gifts may be open to that conversation, but whether to approach them is a personal decision, and an attorney can advise you if you're unsure.

If the parent disagrees. If the biological parent is likely to contest the adoption, or if you aren't sure whether the contact you've seen would count, talk with an attorney about that specific issue. Contested cases turn on facts that no general guide can predict. If the parent's location is unknown, Idaho allows service by publication. Otherwise, personal service by a sheriff or process server is allowed.

What to expect on cost and timing. Idaho court filing fees typically run $150-$250, and the total cost is typically under $1,000 when you file without an attorney, compared with $3,000-$5,000+ for attorney representation. A stepparent adoption in Idaho typically takes 3-6 months. Idaho also waives the home study for stepparent adoptions under Idaho Code § 16-1506.
