If the other biological parent has died, you still complete your stepparent adoption through the Magistrate Court in your Idaho county, and your paperwork will need to show that the parent has passed away. Idaho's general process still applies to you, but exactly how the court handles the deceased parent's side (consent, notice and proof) is something the Magistrate Court clerk in your county or an attorney should confirm for your situation.
What stays the same:
- Court: Your petition is filed in the Magistrate Court in your county. Idaho has 44 counties, and each clerk's office can tell you its local filing procedures.
- Residency: Idaho Code § 16-1506(1) sets a residency period of 6 months.
- Child's consent: If your child is 12 or older, Idaho Code § 16-1504 addresses the child's consent. Your child's own voice in the process does not change because a parent has died.
- Home study: Idaho waives the home study for stepparent adoptions under Idaho Code § 16-1506.
- Spouse's consent: Your spouse, the child's surviving parent, is part of the adoption paperwork as the stepparent's spouse.
What is different:
Much of Idaho's process for a living parent involves getting that parent's written consent or asking the court to end their rights. Because a deceased parent cannot sign anything, your documents will instead need to explain the death. Ask the clerk whether the court expects a certified copy of the death certificate and whether anything else is needed. In Idaho, death records come through the Idaho Bureau of Vital Records and Health Statistics, so if you don't have a certified copy yet, that is the agency to contact.
Timeline and cost:
Idaho stepparent adoptions typically take 3-6 months. Your exact timing depends on your county's court schedule and how quickly your paperwork is complete. Court filing fees in Idaho typically run $150-$250, and the total cost of a stepparent adoption done without an attorney is typically under $1,000, compared with roughly $3,000-$5,000+ when hiring one.
When to get extra help:
Some situations depend on specific facts. If other relatives are involved, if anyone may object, or if you are unsure who the legal parents are, talk to the court clerk or an attorney about that issue. Clerks can explain procedure, and an attorney can advise on your circumstances.
