If the biological father refuses to sign consent in Idaho, the adoption is not automatically over: the paperwork can include a termination petition instead of a consent form, and Idaho handles termination as a separate step. Whether a court grants it depends on the facts of your situation.
Consent or termination. Idaho adoption paperwork includes either consent forms or a termination petition. If the father signs consent, you use the consent route. Consent can be signed any time after the child's birth. If he won't sign, the termination petition takes its place, and you file it in the Magistrate Court in your county.
Abandonment. Idaho Code § 16-2005 sets an abandonment period of 12 months. If the father has abandoned the child under that law, it can be the basis for a termination petition. Whether his situation meets the legal definition is a question for the court. The Magistrate Court clerk in your county or an attorney can tell you how it applies to your family.
Facts to gather. Think through the following and write down what you can:
- When he last saw the child
- When he last contacted the child
- Whether he has provided any support
- Any messages, records or dates that show the timeline
Notifying him. Idaho allows personal service by a sheriff or process server. If you truly don't know where he is, service by publication is allowed. Either way, he is formally notified of the case.
Other requirements. A refusal from the father doesn't change the rest of the process:
- Residency: Idaho Code § 16-1506(1) requires 6 months.
- Child's consent: If your child is 12 or older, Idaho Code § 16-1504 applies.
- Home study: It is waived under Idaho Code § 16-1506.
- Spouse's consent: The petitioning stepparent's spouse must consent to the adoption.
- Filing fee: Court filing fees typically run $150-$250.
Timeline and cost. A stepparent adoption in Idaho typically takes 3-6 months. A contested situation can take longer or need a hearing, and the clerk can tell you what to expect locally. Total cost for a stepparent adoption is typically under $1,000, compared with $3,000-$5,000+ for an attorney.
When to talk to an attorney. If the father is actively involved in the child's life and says he will fight the adoption, that is a contested situation that depends heavily on the facts. Speak with an attorney about that specific issue. The Magistrate Court clerk can answer procedural questions, but not give legal advice.
