Missouri does not state a minimum age for adoptive parents. The statute says "Any person desiring to adopt" may petition (RSMo § 453.010), and we found no age requirement and no required age gap between adult and child in the statute. If you are an adult stepparent, the age of the person adopting is not where Missouri's process usually gets decided. If your situation involves a very young petitioner or an unusual age difference, ask the Circuit Court clerk in your county or an attorney to confirm how the court handles it.
What the court looks at instead. Missouri stepparent adoptions are filed in the Circuit Court, which has the final say. Here are the points that matter more than your age:
- Residency: Missouri has no minimum residency period (RSMo § 453.010).
- Child's consent: The consent age for the child being adopted is 14 (RSMo § 453.030).
- Abandonment: If the other parent has been absent, the abandonment period is 6 months (RSMo § 453.040). Whether it applies depends on your facts, so check with the clerk or an attorney if your case involves an absent or unknown parent, or one who objects.
- Home study: The home study is waived for stepparent adoptions (RSMo § 453.070).
- Background checks: Missouri requires them to protect the child's safety, including a criminal background check for the stepparent.
Adopting an adult. Missouri also allows adult adoption. The person being adopted must be 18 or older, and that person's own written consent alone is sufficient (RSMo § 453.030). The statute does not require the investigation for adults, because it applies to children under eighteen (RSMo § 453.070). Adult adoptions are heard in the juvenile division of the circuit court, and a hearing is required.
Timeline and cost. A stepparent adoption of a child in Missouri typically takes 3-6 months, and an adult adoption typically takes 4-8 weeks. Court filing fees generally run $200-$500, and the typical total cost is under $1,000, compared with $3,000-$5,000+ when hiring an attorney. After the adoption is finalized, the Missouri Department of Health and Senior Services Bureau of Vital Records is the agency that handles birth certificate records. Missouri has 115 counties, and each Circuit Court clerk can tell you about local filing details.
Why it matters. Stepparent adoption can bring inheritance rights, medical decision authority, Social Security survivor benefits and simpler insurance coverage for your child.
