How old do you have to be to adopt in Nebraska?

In Nebraska, you must be an adult to adopt. The statute says "any adult person" may adopt a minor child (Neb. Rev. Stat. § 43-101(1)(a)), and it sets no separate adoption-specific minimum age.

What "adult" means here. Nebraska declares everyone under nineteen to be a minor, and minority ends on marriage (Neb. Rev. Stat. § 43-2101). That is the starting point for the age question. If you are close to that line, or are married and under nineteen, the County Court clerk in your county can confirm how it applies to you.

Age gap between you and the child. We found no required age difference between adopter and child in the statute. If you have a specific situation in mind, ask the clerk or an attorney.

The child's age matters too. Nebraska requires the child's consent if the child is over fourteen (Neb. Rev. Stat. § 43-104). If your stepchild is younger than that, this consent requirement doesn't come into play.

Adopting an adult stepchild. Nebraska also permits adult adoption. An adult child may be adopted by the spouse of that adult child's parent, which covers stepparents. If you are married, your spouse must join the petition. In an adult adoption:

  • The hearing is typically held 4 to 8 weeks after filing, and you must appear in person.
  • A home study is exempt unless the court orders one.
  • The residence-with-petitioner period required before the decree does not apply.

Other basics for a stepparent adoption in Nebraska:

  • Court: Your petition goes to the County Court in the county where you live. Nebraska has 93 counties.
  • Residency: There is no minimum residency period (Neb. Rev. Stat. § 43-102).
  • Home study: It is waived for stepparent adoptions (Neb. Rev. Stat. § 43-107).
  • Timeline: A stepparent adoption typically takes 3-6 months.
  • Court filing fee: The range is $100-$250. Total typical cost is under $1,000 when you file without an attorney, compared with $3,000-$5,000+ for attorney representation.

When to get individual help. Whether the other biological parent must consent, or whether that parent's rights can be ended, depends on your facts. If that parent is unknown, unreachable or likely to contest, talk with the County Court clerk or an attorney about that specific issue.
