How old do you have to be to adopt in Kansas?

In Kansas, you must be an adult to adopt, and the adoption law does not set a specific minimum number beyond that. Under K.S.A. 59-2112(a), "any adult, or married adult couple jointly, may adopt any minor or adult as their child." The age rule in K.S.A. 59-2113 uses the word "adult" and gives no numeric age. Adulthood generally begins at 18, and the District Court clerk in your county can confirm how the court applies it to you.

What this means for a stepparent. If you are an adult married to the child's parent, you meet the basic age requirement to petition. Kansas also states no required age gap between you and the child, but if your situation is unusual, the clerk or an attorney can tell you how the court looks at it.

Other ages that matter in a Kansas adoption.

  • The child's consent age: A child who is 14 has a consent role in the adoption under K.S.A. § 59-2129. Younger children do not have this requirement.
  • Adult adoptees: Kansas also allows the adoption of someone who has reached the age of majority. The petition must state the facts showing the reasons for the adoption, and no relationship or age-gap condition is listed.

Residency. Kansas has no minimum residency period before you can file (K.S.A. § 59-2126(c)).

Where you file. Adoption petitions are filed in the District Court. Kansas has 105 counties, and each has its own clerk's office, including in Wichita, Overland Park, Kansas City, Olathe and Topeka.

What the process looks like.

  • Paperwork: A typical stepparent filing includes a Petition for Adoption, a background information form, and your spouse's consent to the adoption.
  • Home study: For stepparent adoptions, the home study is waived under K.S.A. § 59-2132.
  • Abandonment: If the other birth parent has not been involved and you plan to rely on abandonment, Kansas looks at a 24-month period under K.S.A. § 59-2136. This depends heavily on the facts, so talk to the court clerk or an attorney about your specific situation.
  • Court fees: The filing fee typically runs $150-$300, and the total cost is typically under $1,000, compared with $3,000-$5,000+ when hiring an attorney.
  • Timeline: Stepparent adoptions typically take 3-6 months. Adult adoptions typically take 4-8 weeks.
  • Birth certificate: After the decree, the Kansas Office of Vital Statistics handles updating the birth record.

If your case is contested or the other parent can't be found. These situations depend on the specific facts. Ask the District Court clerk in your county, or an attorney, how the court will handle your case.
