What is the residency requirement for adoption in Missouri?

Missouri has no minimum residency period for adoption, so you do not have to live in the state for a set number of months before you file. The statute is RSMo § 453.010. If you recently moved to Missouri, there is no waiting period to count down.

What this means for you

  • Because there is no required length of residency, there is no clock to track, and the date you changed your driver's license does not matter for a residency period.
  • Stepparent adoptions are filed in the Circuit Court. Missouri has 115 counties, and each one has its own clerk's office.
  • Which county is the right place to file depends on your situation, so the Circuit Court clerk in the county where you live can confirm that for you.
  • For adult adoptions, there is also no adult-specific residency requirement.

Other requirements that matter more than residency

  • Consent: Missouri sets a child consent age of 14 (RSMo § 453.030). Consent from the child's other legal parent, or a legal basis for not needing it, is a separate question that depends on your facts.
  • Abandonment: If the other parent's rights are at issue because of abandonment, Missouri's period is 6 months (RSMo § 453.040). Whether it applies to your family depends on specific facts, so an attorney or the court clerk should answer that for your case.
  • Home study: It is waived for stepparent adoptions (RSMo § 453.070).
  • Background checks: Missouri requires background checks to protect the child, including a criminal background check for the stepparent.
  • Forms: Missouri requires specific forms and language, and the paperwork has to be right for the court to accept it.

Timeline and cost

A stepparent adoption in Missouri typically takes 3-6 months. Court filing fees generally run $200-$500, and the typical total cost is under $1,000. Hiring an attorney commonly costs $3,000-$5,000 or more. After the adoption is final, the Missouri Department of Health and Senior Services Bureau of Vital Records is the agency that handles birth records. The court clerk can tell you the steps for requesting an updated certificate.

Contested or unclear situations

If the other parent is unknown, cannot be found, or may object, the outcome depends on the facts of your case. Please talk with an attorney or the Circuit Court clerk about that specific issue before you file.
