Missouri's stepparent adoption requirements do not set a waiting period after your wedding, and there is no minimum residency period before you can file. The residency rule is in RSMo § 453.010. If a particular county has its own timing practices, the Circuit Court clerk in your county can confirm them.
What this means for you:
- Missouri does not require you to live in the state for a set number of months before filing. Recently moving here is not a built-in wait.
- Missouri's requirements do not tie a minimum length of marriage to the date you can file. The clerk's office can confirm how your Circuit Court handles a very recent marriage.
- Stepparent adoptions are filed in the Circuit Court. Adoption petitions are handled in the juvenile division of the circuit court.
Where the real timing comes from:
- Consent. Missouri sets the child's consent age at 14 (RSMo § 453.030). If your stepchild is 14 or older, plan for that conversation early.
- The other parent. If the other legal parent is not available to consent, Missouri's abandonment provision (RSMo § 453.040) refers to a six-month period. Whether it applies depends on your family's facts. Ask the Circuit Court clerk or an attorney about that specific issue, especially if the other parent might contest the adoption or cannot be located.
- Home study. A home study is waived in Missouri stepparent adoptions (RSMo § 453.070), which removes one possible source of delay.
- Background checks. Missouri requires background checks to protect the child, including a criminal background check for the stepparent, so allow time for those to come back.
- Court processing. Once you file, stepparent adoptions in Missouri typically take about 3-6 months.
Cost: Court filing fees run about $200-$500, and the total typically comes to under $1,000. Hiring an attorney commonly costs $3,000-$5,000 or more.
Why timing matters to families: Until the adoption is final, your stepchild does not have the legal ties that adoption brings, such as automatic inheritance rights, medical decision authority, Social Security survivor benefits and simpler insurance coverage. That is why many couples start the paperwork soon after the wedding. The decision is yours, and you can take the time you need to talk with the other parent and your stepchild.
Next steps:
- Confirm with your county's Circuit Court clerk that there is no local timing step that applies to you.
- Gather your marriage and birth records.
- Consider whether the other parent's consent is likely or whether you need an attorney's guidance.
