Do I have to wait after getting married before I can adopt my stepchild in Illinois?

In Illinois, there is no residency waiting period for a stepparent adoption, and the requirements we work from do not list a set waiting time after the wedding. The residency note for Illinois says the 6-month rule does not apply to a related child (750 ILCS 50/2), so a recent move to the state is not a built-in delay either.

What this means for timing:

  • Illinois sets no residency period for a stepparent adoption, so you are not waiting out a clock before you can start.
  • The petition is filed in the Circuit Court in your county. If you want to confirm anything about local practice, such as how a very recent marriage is handled, the Circuit Court clerk can answer it.
  • Any question about how a judge weighs a particular family's situation depends on your facts. The clerk or an Illinois family law attorney is the right source for that.

What can affect how soon you are ready to file:

  • Child's consent: If your stepchild is 14 or older, Illinois has a consent requirement for the child (750 ILCS 50/12). Talk with your stepchild early so this does not slow you down.
  • The other parent: Whether the other parent consents, cannot be located, or has been absent is the part most likely to shape your timeline. Illinois refers to a 12-month abandonment period (750 ILCS 50/1) and has procedures for cases where the other parent cannot be found. Whether these apply to you depends on your facts, so check with the clerk or an attorney about your specific situation.
  • Home study: Illinois does not require a home study for most stepparent adoptions (750 ILCS 50/6), so you generally do not need to schedule one before filing.

How long it takes once you file: A stepparent adoption in Illinois typically takes about 3-6 months. The time depends on your county's court schedule and on whether everything is in order when you file. An adult adoption, for comparison, typically takes about 4-8 weeks.

What it costs: Court filing fees in Illinois generally run $200-$500, and the typical total cost when you prepare the paperwork yourself is under $565. Hiring an attorney commonly runs $3,000-$5,000+.

Why families do not wait: Adoption gives your stepchild inheritance rights, lets you make medical decisions for them, and opens the way to Social Security and insurance benefits. It also puts your family's bond on legal footing. Since Illinois has no residency waiting period, there is little reason to put off getting your paperwork organized.
