How is stepparent adoption different from third-party adoption in Idaho?

In Idaho, stepparent adoption is a streamlined court process, filed in the Magistrate Court, where the home study is waived under Idaho Code § 16-1506 and the typical timeline is 3-6 months. Third-party adoption means adopting a child who is not your spouse's child, and it follows a different path with more oversight.

What stepparent adoption looks like in Idaho:

  • Home study waived. Idaho does not require a home study for a stepparent adoption (Idaho Code § 16-1506).
  • Timeline. Plan on about 3-6 months from filing to finalization.
  • Court. You file in the Magistrate Court in your county. Idaho has 44 counties, and each clerk's office can tell you about local filing details.
  • Residency. Idaho Code § 16-1506(1) sets a six-month residency period.
  • Consents. The petition is filed with your spouse's consent to the adoption. A child who is 12 or older must also consent (Idaho Code § 16-1504). Idaho allows a parent's consent to be signed any time after birth.
  • The other legal parent. Idaho treats termination of the other parent's rights as a separate step. You either file consent forms or a termination petition. If you are relying on abandonment, the period in Idaho Code § 16-2005 is 12 months.

How third-party adoption differs:

In a third-party adoption, the adopting adult is not married to the child's parent. For an unrelated minor child, service on the Idaho Department of Health and Welfare for an investigation is mandatory. In a stepparent case, the home study is waived. For the specifics of agency, placement and cost in a third-party adoption, an adoption attorney or the Magistrate Court clerk can give you accurate information for your situation.

Cost and time compared:

Idaho court filing fees typically run $150-$250, and a stepparent adoption done without an attorney typically costs under $1,000 in total.
