Can the biological parent request visitation after adoption in Idaho?

Generally, no. In an Idaho stepparent adoption, the other biological parent's rights are addressed before the adoption is finalized, either through their signed consent or through a termination petition. The goal is for you and your spouse to become the child's legal parents. A biological parent whose rights have ended this way does not keep a visitation right from before the adoption.

How the biological parent's rights are handled:

  • Idaho requires either consent forms or a termination petition as part of the stepparent adoption package.
  • Termination is a separate step in Idaho, so it is handled on its own rather than automatically folded into the adoption.
  • Idaho allows consent to be signed at any time after birth.
  • The case is heard in your county's Magistrate Court, and the adoption is governed by Idaho Code Title 16, Chapter 15.

If the biological parent does not agree:

When a parent will not sign consent, a termination petition is the route the package contemplates. Idaho Code § 16-2005 uses a 12-month abandonment period, and that period may matter if abandonment is the issue in your case. Contested cases depend heavily on the facts, so talk to an attorney or the Magistrate Court clerk in your county about your specific situation.

What your adoption timeline looks like:

Stepparent adoptions in Idaho typically take 3-6 months. Until the court signs the final decree, the case is still open. If the other parent has already been involved in court proceedings or has existing orders, ask the clerk how those interact with your adoption.

Questions Idaho law on this page does not settle:

Some situations go beyond what we can state with confidence here:

  • Whether a former parent could ever file any kind of request after the decree
  • How a judge would treat a request in a particular case
  • Whether grandparents or other relatives may have any separate standing
  • Whether a written agreement about contact would be recognized

For any of these, the Magistrate Court clerk in your county or an Idaho family law attorney can give you an answer for your facts. Whether to keep in touch with the biological parent or their family is a personal family decision, and an attorney can explain how any arrangement would be treated legally.

Why this matters when you decide:

Many parents ask this question because they want to know the adoption will give the child a settled, secure family. Getting the consent or termination step right is what that security depends on.
