Can I adopt my stepchild if the biological parent pays child support?
Yes. This is one of the most common misconceptions about stepparent adoption.
Child support and abandonment are completely separate legal concepts:
- Abandonment is about the relationship with the child — physical presence, communication, participation in their life
- Child support is a financial obligation — paying money
A parent who sends child support but has no meaningful contact with the child for the required period (typically 6–12 months depending on state) is still considered to have abandoned the child.
After adoption:
- The biological parent's child support obligation is terminated
- Any child support arrears may still be collectible (varies by state)
- The adopting stepparent assumes full financial responsibility
Important consideration: Once you adopt, the biological parent no longer owes child support. Some families factor this into their timing. But in most cases, the legal and emotional benefits of adoption far outweigh the child support payments.
