No — the biological father must be legally notified through service of process. This is a constitutional requirement to protect due process rights.
However, there are important distinctions:
If his location is known:
- He's served with adoption papers (by sheriff or process server)
- He has a set period to respond
- If he doesn't respond, the adoption proceeds without his consent
If his location is UNKNOWN:
- You can serve by publication — a legal notice in a newspaper
- This satisfies the legal requirement to notify
- He almost certainly won't see it, and the adoption proceeds
- This is very common and courts handle it routinely
If he was never on the birth certificate:
- His parental rights may be limited
- The court may require only reasonable effort to notify
