Can a father on a life sentence have his parental rights terminated in Idaho?

Idaho allows a father's parental rights to be terminated through a separate termination petition in Magistrate Court, but whether a life sentence by itself is enough is something to confirm with the Magistrate Court clerk in your county or an attorney. The answer depends on the facts of your family's situation and on how the judge applies the law.

How Idaho handles termination:

  • Termination is a separate step from the adoption petition. In Idaho, a stepparent adoption package includes either consent forms or a termination petition, along with the Petition for Adoption and your spouse's consent to the adoption.
  • If the father is willing to sign consent, that route may apply instead of a contested termination. Idaho allows consent to be signed any time after birth.
  • If he will not consent, the termination petition is the route, and the court decides it.

Abandonment as a possible ground:

  • Idaho's abandonment period is 12 months, under Idaho Code § 16-2005.
  • Whether abandonment fits depends on his actual contact and support history with your child. Being in prison does not answer that question by itself, so ask the clerk or an attorney how a judge would view your facts.
  • A contested case, where the father opposes termination, is the kind of situation where you should get advice from an attorney about your specific circumstances.

Notifying him in prison:

  • Idaho allows personal service by a sheriff or process server. If a parent's location is unknown, service by publication is allowed.
  • A father in a correctional facility has a known location, so personal service is the likely method. The clerk can tell you how your county handles service at a facility.

Other Idaho requirements that still apply:

  • Court: Magistrate Court in your county. Idaho has 44 counties.
  • Residency: Idaho Code § 16-1506(1) sets a residency period of 6 months.
  • Child's consent: A child who is 12 or older must consent, under Idaho Code § 16-1504.
  • Home study: Idaho waives the home study in stepparent adoptions under Idaho Code § 16-1506.
  • Timeline: Stepparent adoptions in Idaho typically take 3-6 months.
  • Costs: Court filing fees run about $150-$250. The typical total when you file yourself is under $1,000, compared with $3,000-$5,000+ for an attorney.

What to do next: Gather what you know about the father's contact and support history, his current facility and the dates involved. Then ask the Magistrate Court clerk what the court requires when a parent is incarcerated. If he is likely to contest, speak with an Idaho attorney about that issue.
