Generally yes. Foster care history is not listed among Idaho's stepparent adoption requirements, and these adoptions are handled in the Magistrate Court. How your earlier foster care case affects your own adoption depends on the facts, so confirm those details with the Magistrate Court clerk in your county or with an attorney.
What depends on your history:
- Whether a court already ended a parent's rights. Idaho treats termination of parental rights as a separate step from the adoption petition. If your foster care case ended with a termination order, bring copies to the clerk and ask how they should be handled in your filing.
- Whether you went back to your parent. If you returned to the parent married to your stepparent, the other parent's consent, or a legal basis to proceed without it, still has to be addressed. Idaho Code § 16-2005 sets an abandonment period of 12 months. Whether it fits a situation involving foster care depends on the facts, and an attorney can advise on that.
- Whether a parent's whereabouts are unknown or a parent objects. Idaho allows service by publication if a location is unknown, but contested or unknown-parent cases are best reviewed with an attorney.
If you are under 18: Idaho sets the child consent age at 12 under Idaho Code § 16-1504. If you are 12 or older, your own consent is part of the process.
If you are 18 or older: Idaho's typical adult adoption timeline is 4-8 weeks. Because your history involved the court system, ask the clerk whether any old foster care orders should be included with your paperwork.
