What if the other parent won't sign consent in Indiana?

Even if the other parent won't sign consent, your stepparent adoption in Indiana may still be able to go forward. If that parent has failed to maintain meaningful contact or support, Indiana courts can proceed without their consent.

Where the 6-month period fits in. Indiana uses a 6-month abandonment period, found at Ind. Code § 31-19-9-8. A parent who simply refuses to sign is not the same as a parent whose consent isn't needed. What matters is the facts of that parent's contact with and support of your child. How a judge weighs those facts in your case is a question for the Circuit or Superior Court in your county, or for an attorney.

What "won't sign" can look like:

  • The other parent has been absent. They haven't kept up contact or support and just aren't responding or cooperating. This is the situation where Indiana courts can move ahead without consent.
  • The other parent is involved and says no. This is a more fact-dependent situation. Because the outcome turns on your specific circumstances, talk with an Indiana family law attorney about it, and ask the Circuit or Superior Court clerk about local procedures.
  • You don't know where the other parent is. Indiana has procedures for giving notice by publication when the other parent can't be located after reasonable efforts.

Termination and child support. In Indiana, termination of the other parent's rights is not a separate step you have to file on its own. Unpaid child support doesn't prevent an adoption, though the adoption may not erase existing support obligations. Ask the court about your situation.

Your child's own consent. Separate from the other parent, Indiana sets a child consent age of 14 under Ind. Code § 31-19-9-1. If your child is 14 or older, plan for that part of the process.

What to expect. Indiana stepparent adoptions typically take 3-6 months. Court filing fees generally run $200-$500, and the total typical cost is under $1,000, compared with $3,000-$5,000+ when hiring an attorney. Indiana also requires a final court hearing, which is typically a brief, positive proceeding. If the other parent contests the adoption, your timeline and costs may differ, and the clerk or an attorney can tell you more.

Practical steps:

  • Write down when the other parent last had contact with your child and when they last provided support.
  • Gather any messages, letters, or records that show the pattern.
  • Note the other parent's last known address, and any efforts you've made to reach them.
  • Call the Circuit or Superior Court clerk in your county with questions about local filing requirements.
