What if the other parent won't sign consent in Kentucky?

If the other parent won't sign consent in Kentucky, your adoption can still move forward through the Circuit Court by asking the court to dispense with that parent's consent. A signature is not the only path.

Abandonment can be grounds. Kentucky has one of the shorter abandonment periods: 3 months, or 90 days, of no contact can establish grounds for proceeding without the other parent's consent (KRS § 199.502). Whether your situation meets that standard depends on the facts, so the Circuit Court clerk in your county or an attorney can confirm how it applies to you.

How the paperwork works. Kentucky's process includes these pieces:

  • A Petition for Adoption.
  • Consent forms, or a motion to dispense with consent when the other parent will not sign.
  • Your spouse's consent to the adoption.
  • Criminal background checks through the Kentucky State Police for the petitioners.

Kentucky does not treat termination as a separate case, so you don't need to open a second proceeding for it.

Notifying a parent who won't cooperate. The other parent generally has to be formally notified of the case. Kentucky allows personal service by a sheriff or process server. If you truly don't know where the parent is, service by publication is allowed after a diligent search. Ask the clerk what that search must include.

When the parent is involved and says no. If the other parent has been active in your child's life and refuses to consent, the case may be contested. That depends heavily on the specific facts. In that situation, talk with a Kentucky family law attorney about that issue, even if you prepare the rest of your paperwork yourself.

Other Kentucky basics that still apply.

  • Residency: There is no waiting period for Kentucky residents. Non-residents need 12 months in the state (KRS § 199.470).
  • Your child's consent: Kentucky sets a child consent age of 12 (KRS § 199.500).
  • Home study: It is waived in stepparent adoptions (KRS § 199.473).
  • Timeline: Stepparent adoptions in Kentucky typically take 3-6 months.
  • Cost: Court filing fees run about $150-$300, and the typical total cost is under $1,000. By comparison, attorneys commonly charge $3,000-$5,000+.

What to do first. Write down the date of the last real contact the other parent had with your child, and gather anything that shows it, such as messages, cards, or records of missed visits. Then call the Circuit Court clerk in your county (Kentucky has 120 counties) to ask about local filing steps and how they handle a motion to dispense with consent.
