Can I adopt my stepchild in Kentucky if the bio parent only has supervised visitation?

Yes. You can file a stepparent adoption petition in a Kentucky Circuit Court even when the biological parent has only supervised visitation. What matters is whether that parent consents or the court is asked to proceed without their consent.

Why the visits matter: Kentucky's abandonment period is short. Just 90 days (three months) of no contact can establish grounds for proceeding under KRS § 199.502. If the parent has stopped using their supervised visits, that gap may be relevant. Whether missed visits count as "no contact," or how a court treats a parent who still attends some visits, depends on your facts. Please confirm that point with the Circuit Court clerk in your county or an attorney.

Two paths, depending on the parent:

  • The parent agrees. You file the Petition for Adoption along with their signed consent form.
  • The parent does not agree. You file a motion to dispense with consent instead. This is a contested situation, so an attorney can give you advice specific to your case.

Other consents and requirements:

  • Your spouse, the child's parent, must also consent to the adoption.
  • Kentucky sets a child consent age of 12 (KRS § 199.500).
  • Petitioners must complete a criminal background check through the Kentucky State Police.
  • The home study is waived (KRS § 199.473), so you aren't waiting on one.

Notifying the other parent: Kentucky allows personal service by a sheriff or process server. If you truly don't know where the parent is, service by publication is allowed after a diligent search. Supervised visitation orders often mean there's a paper trail, which can help show where the parent was last known to be.

Residency: There is no waiting period for Kentucky residents. Non-residents need 12 months in the state (KRS § 199.470).

What to gather:

  • A copy of the existing custody or visitation order.
  • Any records showing which supervised visits happened and which did not, such as visitation center logs, messages, or your own dated notes.
  • The child's birth information and your marriage details.

Timeline and cost: Stepparent adoptions in Kentucky typically take 3-6 months. Court filing fees run $150-$300, and the total typical cost is under $1,000, compared with $3,000-$5,000+ when hiring an attorney. The Circuit Court clerk can confirm the exact fee for your county.
