The biological father agrees to the adoption — what's the process in Kentucky?

In Kentucky, when the biological father agrees, you file a petition for adoption in Circuit Court in your county together with his signed consent, and the case moves toward a finalization hearing, typically in about 3-6 months. His agreement keeps things straightforward, because the case centers on his consent rather than on proving grounds against him.

Residency: There is no waiting period for Kentucky residents (non-residents need 12 months in the state), under KRS § 199.470.

What you will typically put together:

  • A Petition for Adoption
  • The father's consent form (a motion to dispense with consent is for cases where consent isn't given)
  • Your spouse's consent to the adoption, meaning the child's parent who is married to you
  • Criminal background checks through the Kentucky State Police for the adoption petitioners

How the process usually runs:

  • Prepare the papers. Complete the petition and consent forms for your county. Kentucky has 120 counties, and the Circuit Court clerk in yours can confirm local filing details.
  • Get the consents signed. The father signs his consent, and your spouse signs the spouse's consent. Ask the clerk how the signing must be witnessed or notarized so nothing has to be redone.
  • Complete the background checks. Kentucky requires them through the Kentucky State Police for petitioners.
  • File with the Circuit Court clerk. The court filing fee typically runs $150-$300.
  • Attend the hearing. The court reviews your case and, if everything is in order, finalizes the adoption. After that, the Kentucky Office of Vital Statistics is the agency that handles birth records, and the clerk can tell you how to request updated records.

Home study: Kentucky waives the home study for stepparent adoptions under KRS § 199.473, so you don't need to schedule one.

If the child is 12 or older: Kentucky sets the child's consent age at 12 (KRS § 199.500), so an older child's own consent is part of the picture.

Why the father's agreement matters: Kentucky's abandonment period is short, just 3 months of no contact under KRS § 199.502. That only comes into play if a father does not consent. If he agrees now but later changes his mind, or if there is any dispute about his rights, talk with the Circuit Court clerk or an attorney about that specific situation. The same goes for anything unusual in your family's circumstances. Kentucky's adoption laws are in Kentucky Revised Statutes Chapter 199.

Cost: The court filing fee is $150-$300, and the total for a stepparent adoption that you file yourself is typically under $1,000. Hiring an attorney typically costs $3,000-$5,000+.
