What if the biological father refuses to consent to adoption in Kentucky?

3 min readHelping families since 2001Kentucky

A father's refusal does not automatically end a stepparent adoption in Kentucky. You can ask the Circuit Court to move forward without his consent, and the outcome depends on the facts of your situation.

The abandonment route. Kentucky has one of the shorter abandonment periods. Just 90 days (three months) of no contact can establish grounds for proceeding, under KRS § 199.502. If the father has had no contact with your child for at least that long, his refusal to sign is not the end of the road. The court will look at the facts and make the decision, not you and not him.

What the court may look at. These are questions worth thinking through before you file:

  • When did he last see your child?
  • When did he last communicate with your child?
  • Is there any record of calls, messages, visits or support?

Gather whatever records you have. The Circuit Court clerk in your county can tell you what the court expects to see.

Paperwork when he won't sign. Kentucky's process involves:

  • A Petition for Adoption
  • Consent forms, or a motion to dispense with consent when a parent will not sign
  • Your spouse's consent to the adoption (the child's parent, who is married to you)
  • Criminal background checks through the Kentucky State Police for the petitioners

Termination of his rights is not a separate case in Kentucky. It is handled within the adoption.

Notifying the father. He must be formally notified of the case. Kentucky allows personal service by a sheriff or process server. If you truly do not know where he is, service by publication is allowed after a diligent search. The clerk can confirm exactly what that search must include.

Residency and your child's voice. There is no waiting period for Kentucky residents, though non-residents need 12 months in the state (KRS § 199.470). If your child is 12 or older, your child's own consent is also part of the process (KRS § 199.500). Kentucky also waives the home study for stepparent adoptions (KRS § 199.473).

When it becomes a real contest. If the father is involved in your child's life and actively fights the adoption, the case turns on specific facts, and the court will weigh them. That is the point to speak with a Kentucky family law attorney about your particular situation. The court clerk can explain procedure, but not give legal advice.

Timeline and cost. Stepparent adoptions in Kentucky typically take 3-6 months. Court filing fees generally run $150-$300, and the total is typically under $1,000, compared with $3,000-$5,000+ when hiring an attorney. A contested case may involve different timing and costs, depending on what the court requires.
