What if the biological father refuses to consent to adoption in Indiana?

A father's refusal to consent does not automatically stop a stepparent adoption in Indiana. If he has failed to maintain meaningful contact or support, Indiana courts can proceed without his consent.

How abandonment fits in. Indiana's abandonment provision, Ind. Code § 31-19-9-8, uses a period of 6 months. Whether a particular father's situation meets it depends on the facts, such as when he last saw the child, when he last communicated, and whether he has provided support. The Circuit or Superior Court in your county looks at those facts. Whether the 6 months has been met in your case is a question for the court clerk or an attorney.

What the court may look at when a father objects:

  • When he last had contact with your child
  • When he last communicated with your child
  • Whether he has provided financial support
  • Whether he has been a meaningful presence in your child's life

If he is actively involved and fights the adoption. The outcome then depends heavily on the specific facts. If he is currently in your child's life and objects, speak with an attorney about your situation, and ask the court clerk in your county how contested matters are handled locally.

If you don't know where he is. Indiana has procedures for giving notice by publication when the other parent cannot be located after reasonable efforts. You don't need his address to move forward, but you do need to show the effort to find him.

If he owes back child support. Unpaid support does not prevent an adoption in Indiana. The adoption may not erase existing support obligations, so ask the court about your specific situation.

Other points that may help:

  • Termination of his rights is not handled as a separate case in Indiana. It is addressed within the adoption.
  • Indiana has no minimum residency period before you can file (Ind. Code § 31-19-2-2).
  • Indiana does not set a minimum length of marriage, but courts want to see a stable relationship.
  • Your child's own consent is a separate matter from the father's. The consent age in Indiana is 14 (Ind. Code § 31-19-9-1).
  • The home study is waived for stepparent adoptions (Ind. Code § 31-19-8-5).
  • A final hearing is required, and these are typically brief, positive proceedings.

Cost and timeline. Court filing fees in Indiana typically run $200-$500, and the total cost is typically under $1,000, compared with $3,000-$5,000+ when hiring an attorney. Stepparent adoptions usually take 3-6 months. A contested case may take a different amount of time, so ask the clerk or an attorney.
