Do I need the biological father's consent for stepparent adoption in Indiana?

Not always. In Indiana, a biological father's consent is not the only path to a stepparent adoption. If he agrees, he can consent. If he has failed to maintain meaningful contact or support, Indiana courts can proceed without his consent.

If he agrees: A father who supports the adoption can give his consent. This often keeps things simpler, because there is nothing for the court to decide about his role.

If he doesn't agree or isn't involved: Indiana sets an abandonment period of 6 months in Ind. Code § 31-19-9-8. Whether your situation fits depends on the facts: how much contact he has had, what support he has provided, and what the judge decides. The Circuit or Superior Court in your county makes that call, so a contested situation is worth discussing with the court clerk or an attorney.

  • Back child support: Unpaid child support doesn't prevent an adoption in Indiana. The adoption may not erase support that is already owed, so ask the court about your specific situation.
  • You don't know where he is: Indiana has procedures for giving notice by publication when the other parent can't be located after reasonable efforts. Keep a record of the steps you take to find him.
  • No separate termination case: Indiana doesn't treat termination of parental rights as a separate proceeding in this situation.
  • Your child's consent: Separate from the father's consent, Indiana sets a child consent age of 14 under Ind. Code § 31-19-9-1.
  • Residency: Indiana has no minimum residency period under Ind. Code § 31-19-2-2.
  • Home study: A home study is waived under Ind. Code § 31-19-8-5.

What to expect: Indiana requires a final court hearing. These are typically brief, positive proceedings. Stepparent adoptions in Indiana usually take about 3-6 months. Court filing fees typically run $200-$500, and the total cost is typically under $1,000, compared with $3,000-$5,000+ when hiring an attorney.

When to get individual help: If the father is likely to object, if you aren't sure whether his contact and support would count, or if you can't find him, ask the Circuit or Superior Court clerk in your county or an attorney about your particular facts.
