Do I need the biological father's consent for stepparent adoption in Kentucky?

Not always. In Kentucky, the biological father's consent is the usual route, but if he has had no contact with your child for 90 days (three months), that can establish grounds for the adoption to go forward without his consent under KRS § 199.502. Whether his situation meets that standard depends on the facts, so the Circuit Court in your county makes the call.

A signed consent form from the father is the simplest path. Kentucky's filing paperwork includes the Petition for Adoption and consent forms. Your spouse, the child's parent, also signs a consent to the adoption.

If he is not willing, or has been absent

In that case, the paperwork includes a motion to dispense with consent instead of his consent form. Kentucky does not require a separate termination case. The question is handled within the adoption itself.

Notifying the father

Even when you are asking the court to proceed without his consent, he generally needs to be properly notified of the case. Kentucky allows:

  • Personal service by a sheriff or process server
  • Service by publication if his location is unknown

The Circuit Court clerk in your county can tell you exactly what the court expects before publication is allowed.

If he objects

If the father contests the adoption, or if you are unsure whether his lack of contact meets the standard, that is a situation where the facts matter a great deal. Ask the Circuit Court clerk about procedure, and consider speaking with a Kentucky attorney about your specific circumstances.

Kentucky has a separate consent rule for the child: a child who is 12 or older must consent to the adoption under KRS § 199.500.

Other Kentucky basics

  • Court: You file in the Circuit Court in your county.
  • Residency: Kentucky residents have no waiting period (non-residents need 12 months in the state), under KRS § 199.470.
  • Home study: It is waived in stepparent adoptions under KRS § 199.473.
  • Background checks: Petitioners complete criminal background checks through the Kentucky State Police.
  • Filing fee: Court filing fees typically run $150-$300, and the total cost is typically under $1,000, compared with $3,000-$5,000+ for an attorney.
  • Timeline: Stepparent adoptions in Kentucky typically take 3-6 months.
