Can I adopt my stepchild in Idaho if I was previously married to someone else?

Yes, you can ask the Idaho Magistrate Court to approve adoption of your stepchild as the current spouse of the child's parent, and a previous marriage is not one of the Idaho requirements for a stepparent adoption. The court process is built around your relationship with this child and the family's current situation, not around your marital history.

What Idaho's process centers on:

  • Your current marriage. Idaho's filing includes your spouse's consent to the adoption, so the marriage to the child's parent is the foundation of the case.
  • Residency. Idaho sets a residency period of 6 months under Idaho Code § 16-1506(1).
  • Consent or termination. The filing includes either consent forms or a termination petition for the other legal parent. Idaho allows consent to be signed any time after birth.
  • Abandonment. Where a parent has not been involved, Idaho Code § 16-2005 uses a 12-month abandonment period.
  • The child's consent. Idaho sets the child consent age at 12 under Idaho Code § 16-1504.
  • Home study. Idaho waives the home study for stepparent adoptions under Idaho Code § 16-1506.

These rules come from Idaho Code Title 16, Chapter 15, along with the related sections above.

What about your past marriage? Some details depend on your facts. For example, the court may want to see paperwork showing how an earlier marriage ended, or you may have existing court orders involving your own children or your stepchild. Idaho law on those points should be confirmed with the Magistrate Court clerk in your county (Idaho has 44 counties) or with an attorney who can look at your situation. If the other biological parent is contesting the adoption or cannot be located, that is also worth discussing with an attorney.

Cost and timeline: Court filing fees in Idaho typically fall in the $150-$250 range. A stepparent adoption done without an attorney typically costs under $1,000 in total, compared with $3,000-$5,000+ for attorney representation. The timeline for a stepparent adoption is typically 3-6 months.

Your history doesn't take away what you've built. Blended families come in many shapes. If you are already parenting this child, adoption makes the relationship official, and your earlier marriage is simply part of your family's story.
