Can I adopt my stepchild if we recently moved to Arizona?

Yes, you can start a stepparent adoption right after moving to Arizona, because Arizona sets no minimum residency period. You do need to be an Arizona resident when you file. A.R.S. § 8-103 says any adult resident of the state, whether married, unmarried or legally separated, is eligible to adopt, and it sets no waiting period before you qualify.

What this means for you:

  • You don't have to wait months after your move before filing.
  • The petition goes to the Superior Court in your Arizona county. Arizona has 15 counties, including those around Phoenix, Tucson, Mesa, Scottsdale and Chandler.
  • What the court accepts as proof that you live in Arizona can depend on your situation. The Superior Court clerk in your county can tell you what to bring.

If you haven't fully settled in yet: Nonresidents qualify only in a narrow dependent-child situation described in A.R.S. § 8-103. If your move isn't complete, or you're unsure whether you count as a resident, check with the Superior Court clerk or an attorney before filing.

Things that may come up after a recent move:

  • Orders from your old state. If a custody or parental rights order was issued elsewhere, how it affects your Arizona case depends on your facts. Ask the clerk or an attorney about that specific issue.
  • Records. Gather your marriage certificate and your stepchild's birth certificate. For records issued in Arizona, the Arizona Office of Vital Records is the agency to contact.
  • Fingerprint clearance. Arizona requires fingerprint clearance for adoption petitioners, so plan for that early.
  • The other parent. Arizona's process uses either consent forms or a motion to sever parental rights, along with your spouse's consent to the adoption. If the other parent will not consent or can't be found, the abandonment period is 6 months (A.R.S. §§ 8-531(1), 8-533(B)(1)). Whether that applies depends on the facts, so a contested or unknown-parent situation is worth discussing with an attorney.
  • Your stepchild's consent. Arizona sets the consent age at 12 (A.R.S. § 8-106).

Home study: For stepparent adoptions, Arizona's data shows the home study is waived (A.R.S. § 8-105). That removes one step that can slow families down.

Timeline and cost: Stepparent adoptions in Arizona typically take 4-8 months. Court filing fees generally run $200-$350, and the total typically comes to under $1,000, compared with $3,000-$5,000+ for many attorney-handled cases.
