An Arizona minor stepparent-adoption petition goes through the juvenile division of the superior court in the applicable county. Confirm the venue, resolve the consent and notice route, prepare the petition and supporting records, and follow the court's investigation and hearing instructions.
Submitting a questionnaire to a private preparation service does not file the court case. The case must be submitted through a method accepted by the proper clerk.
1. Choose the county and preparation support
A.R.S. §8-104 addresses venue in the prospective adoptive parent's county or, where applicable, the county where the child is a ward. Confirm the court division and location before using a generic family-law or adult-adoption packet.
Ask the county attorney about adoption assistance under §8-127. The statute provides for preparing the minor-adoption petition and representation without expense to the prospective adoptive parent, with rules for withdrawal if contested. It expressly excludes the separate adult-adoption route. Ask the office about the application and your circumstances.
A family may also choose paid document preparation or private legal representation. Decide what help is included: preparing papers, filing them, handling notice and representing the family are different tasks. StepParentAdoption360 is a document-preparation service, not a law firm.
2. Build the petition and supporting file
| Preparation item | Check before submitting |
|---|---|
| Petitioner's identity and residence | Full legal names, age, address and marriage details |
| Child's identity and current circumstances | Birth details, custody history and requested name |
| Certification or exemption | State the correct basis for this case |
| Consents or applicable legal alternative | Attach or arrange the required documents and records |
| Child's property and adoption-related payments | Provide accurate information requested by the petition |
| Local documents and proposed order | Confirm the court's format and submission process |
§8-109 states the petition's contents. Gather supporting records early and read each declaration before signing. A missing paternity order or inaccurate statement about certification should be corrected before the packet reaches the court.
Arizona's consent-signing rules differ from some neighboring states. Check the consent guide below rather than importing another state's notary-and-witness instructions. Child consent at age 12 or older also includes the statutory open-court requirement.
3. Submit through the accepted method and budget accurately
Ask the clerk how to start this particular juvenile adoption case. Electronic availability for civil cases or later juvenile filings does not establish that a new adoption can be opened through the same system.
The Arizona superior-court fee schedule, effective December 28, 2024, lists an adoption petition or application as N/C—no charge. Check current local requirements and budget separately for any records, investigation, service or other necessary expense. The old $200–$350 filing estimate should not be used as the published state adoption charge.
Our preparation fee is $349, with a separate $99 mailing fee, under the service terms. These private charges are separate from the court's fee schedule and any county-attorney assistance.
4. Track the open case through the hearing
Save the accepted petition, case number, department and any rejection or correction notice. Read each court request and keep its deadline with the responsible task. Filing is a milestone, not the final adoption.
§8-111 addresses hearing notice, including people whose consent is required unless the applicable waiver has been filed. Notice and service are not automatically completed by buying a document package.
Confirm the social-study and records-check arrangements before the hearing. The court may require corrections or additional evidence. The Arizona guides below provide a separate investigation explanation, online-filing check and hearing planner, while the Phoenix guide adds local Maricopa County contacts and locations.
