What is the adult adoption process in Arizona?

Arizona adult adoption involves a qualifying relationship or age category, a written agreement, a petition, a report before the hearing and the court's decision. File in the county where either the adopting person or proposed adoptee resides. A.R.S. §14-8101 provides the controlling framework; the court's actual instructions determine the filing method and schedule.

Follow the Arizona court stages

StageWhat to organizeWhat establishes completion
Eligibility and rolesThe statutory category, relationship and correct adopter/adoptee roles. The actual facts support the proposed request.
Agreement and petitionWritten agreement, petition information and applicable spouse consent.Documents completed and signed as instructed.
Filing and court directionsProper county, local submission requirements and separate charges.Accepted filing and directions for remaining work.
Report and noticeCourt-designated report and any ordered investigation or notice.Required report and proof of compliance.
Hearing and decreeRequired attendance and documents. The judge approves the agreement and issues a decree.

Confirm eligibility before preparing the agreement

The Arizona eligibility guide explains the distinction between a current or former adult stepchild and the separate 18–21 category. Do not assume every unrelated adult qualifies at any age.

Under §14-8101(B), the written agreement states the parties' decision to assume the legal parent-child relationship, including its rights, duties and responsibilities. The adopting person and proposed adoptee sign the agreement. Applicable spouse consent is a separate issue.

Prepare the petition information accurately

Section F identifies the required subjects: the length and nature of the relationship, any kinship, the reasons and best-interests explanation, the names and addresses of living parents or adult children of the adoptee, and prior adult adoptions by the adopter or spouse.

Gather those facts and disclose missing information or existing orders to the preparer. Do not omit parents' details because their consent is unnecessary. The consent-and-notice guide explains why those are different questions.

File and obtain the report instructions

Confirm the correct Superior Court division, local forms, filing method, current charges and copies with the court. Our standard preparation price is $349 for the first adoptee, with $99 per additional adoptee in the same case; it does not pay the clerk or another provider.

For a Maricopa County filing, the court's adult-adoption packet page links its agreement and petition, investigator information sheet, applicable spouse consent, notice proof and proposed decree. Its procedures distinguish the birth-certificate copy used when requesting a hearing from the certified copy brought to the hearing. Follow that court's current checklist rather than applying it to every Arizona county.

Section D calls for a written report before the hearing from a court-designated person. The court may direct additional investigation and require notice to interested people. Obtain the actual assignment and instructions instead of assuming that adult adoption eliminates all inquiry or service.

Arrange the required appearance

Both parties ordinarily appear in person. The statute allows an attorney with written authorization to appear for someone unable to attend. Confirm the arrangement with the court; do not simply miss the hearing or assume a remote appearance is automatically allowed.

The judge examines the parties or the authorized attorney and considers best interests and the public interest. Interested people may object. Legal help may be appropriate for an anticipated dispute or uncertainty about the statutory categories.

Plan timing from completed steps

The statute does not promise finalization in two to three months. Track the accepted filing, report assignment, required notice, investigation requests, hearing date and any corrections. Ask the court which unfinished item prevents the next stage. A document-delivery estimate does not establish when a judge will finalize the case.

Keep the decree and update records separately

Obtain the signed decree and confirm any separate records requests. Use the direction guide if the wording of the proposed relationship is unclear, then start the Arizona adult questionnaire. Read the Terms of Service for the document guarantee's conditions. The distinct Texas process has different venue, spousal-joinder and attendance rules.
