Can I adopt my stepchild if we recently moved to New Mexico?

Yes. New Mexico sets no minimum residency period for a stepparent adoption of a child, so having just moved does not by itself stop you from filing (NMSA 1978 § 32A-5-11). The case is filed in the District Court, and you can start preparing right away.

What this means for a recent move:

  • You do not have to wait out a waiting period before you begin.
  • Where exactly to file, and what the court wants to see about your move, depends on your county. The District Court clerk in the county where your family lives can confirm this.
  • If your child's other parent lives in another state or you are unsure of their whereabouts, that is a fact-specific situation. Ask the clerk or a New Mexico attorney how it applies to you.

If the person you want to adopt is an adult (18 or older): New Mexico handles this under a separate law, not the one for children. Adopters must be "Residents," meaning they lived in New Mexico for at least six months immediately before filing, or are domiciled there with the intent to remain indefinitely (NMSA 40-14-2). Venue is any county where the petitioner or the adoptee lives (NMSA 40-14-4). A recent move could matter here, so check the timing carefully.

Other points to know as a newly arrived family:

  • Child's consent: A child who is 14 or older has a consent role (NMSA 1978 § 32A-5-17).
  • Other parent's consent: If the other legal parent will not consent, the court looks at whether the parent has abandoned the child. New Mexico uses a six-month period for abandonment (NMSA 1978 § 32A-5-15(B)(1)). Whether that applies to your family depends on your facts, so ask the clerk or an attorney.
  • Home study: New Mexico waives the home study in stepparent adoptions (NMSA 1978 §§ 32A-5-14, 32A-5-31).
  • Spouse's role: The paperwork includes your spouse's consent to the adoption.
  • Timeline: Stepparent adoptions in New Mexico typically take 3-6 months once filed.
  • Court costs: Court filing fees typically run $150-$300, and the total typically comes to under $1,000 when you handle the filing yourself. Attorney-handled adoptions commonly run $3,000-$5,000+.

Getting organized now:

  • Gather your marriage certificate, your stepchild's birth certificate and proof of your New Mexico address.
  • Collect any existing court orders about custody or parental rights from your previous state.
  • Note where the other parent lives and when you last had contact, since this affects consent and service.
