Can I adopt my stepchild if the biological parent's rights were already terminated in Idaho?

Yes, you can ask the Idaho Magistrate Court to approve a stepparent adoption of your stepchild after the biological parent's rights have been terminated. Idaho treats termination of parental rights as a separate step from the adoption itself (Idaho Code Title 16, Chapter 15). If a court has already completed that step, you are moving on to the adoption petition.

What a prior termination changes

Idaho's usual filing package includes a Petition for Adoption, either consent forms or a termination petition, the spouse's consent to the adoption, and the filing fee. A prior termination order takes the place of the consent-or-termination part of that package. Keep a copy of the order and the case number handy, because the court will want to see how the rights ended. Ask the Magistrate Court clerk in your county whether a certified copy is required and whether anything else is needed because of the earlier case.

What still applies

  • Petition for Adoption: You file it in the Magistrate Court in your county.
  • Your spouse's consent: Idaho's list of required papers includes the spouse's consent to the adoption.
  • Child's consent: If your stepchild is 12 or older, Idaho Code § 16-1504 addresses the child's consent.
  • Residency: Idaho's residency period is 6 months (Idaho Code § 16-1506(1)). The clerk can confirm how it applies to your family.
  • Home study: Idaho waives the home study for stepparent adoptions (Idaho Code § 16-1506).
  • Filing fee: Court filing fees typically run $150-$250, and the total cost is typically under $1,000. Attorney-handled adoptions commonly run $3,000-$5,000+.

Where abandonment fits in

Idaho Code § 16-2005 sets a 12-month abandonment period. That matters for families whose rights have not yet been terminated and who need to go that route. If the termination is already on the books, you generally won't be building that case from scratch, but ask the clerk how the court wants the earlier order presented.
