Can I adopt my stepchild if I work out of state but live in Missouri?

Yes. Working out of state does not stop you from adopting your stepchild in Missouri. Missouri sets no minimum residency period for stepparent adoption (RSMo § 453.010), so there is no waiting period to complete before you file, whether you travel for work or commute across the state line.

What this means for you:

  • There is no required number of months of Missouri residency before you can start.
  • Your home base is what matters in practice. If you live in Missouri with your family, you are filing where your family lives.
  • Missouri's statute gives no minimum age for the adopting person. It says only that "any person desiring to adopt" may petition.
  • The adoption is handled by the Circuit Court. The Circuit Court clerk in your county can confirm the exact filing location and local procedures, especially if your work schedule keeps you away often.

How your work schedule can still matter: Some steps involve you personally, such as signing documents, completing a criminal background check, and attending the court hearing. Missouri requires background checks for child safety. If your job takes you away for long stretches, plan these steps around your schedule. If you might not be able to attend in person, ask the Circuit Court clerk or an attorney how the court handles that. This is not something we can promise for every situation.

Other Missouri requirements:

  • Child's consent: Missouri's consent age for the child is 14 (RSMo § 453.030).
  • Other parent: If the other legal parent is involved, the court looks at consent. If you are relying on abandonment, Missouri uses a 6-month period (RSMo § 453.040). If the other parent is absent, unknown, or disputes the adoption, talk to the court clerk or an attorney about your specific facts.
  • Home study: Missouri waives the home study for stepparent adoptions (RSMo § 453.070).
  • Timeline: Stepparent adoptions in Missouri typically take about 3-6 months.
  • Cost: Court filing fees typically run $200-$500, and the total is typically under $1,000. Attorney-handled adoptions commonly run $3,000-$5,000+.

When to get a second opinion: If you split time between two states, have a more complicated living arrangement, or expect a contested case, a local attorney or the Circuit Court clerk can tell you how those facts apply to you. Your situation may have details that a general answer cannot cover.
