When should I start the stepparent adoption process in Arizona?

You can start your Arizona stepparent adoption as soon as you are an Arizona resident, because A.R.S. § 8-103 sets no minimum residency period. You don't have to live in the state for a set number of months before you file.

Why sooner is often easier. The typical timeline is 4-8 months, so starting earlier means your family is legally official earlier. The adoption is filed in the Superior Court in your county, and the timeline depends partly on how quickly the paperwork is complete and the other parent's situation is sorted out.

Things that may affect when you start:

  • Consent of the other legal parent. Arizona's process calls for consent forms or a motion to sever parental rights, plus your spouse's consent to the adoption. If the other parent is willing to sign, you can move quickly. If not, allow more time, since termination is handled as a separate step.
  • Abandonment and the 6-month period. Arizona's abandonment provisions (A.R.S. §§ 8-531(1), 8-533(B)(1)) refer to a 6-month period. Whether that applies to you depends on the facts of your situation, so ask the Superior Court clerk in your county or an attorney about your circumstances.
  • Your child's age. Arizona sets a consent age of 12 (A.R.S. § 8-106). If your stepchild is close to that age, it is worth knowing before you file, and the court clerk can explain how it would apply to you.
  • Fingerprint clearance. Arizona requires fingerprint clearance for adoption petitioners. Ask the clerk how long it typically takes so you can plan around it.
  • Unknown whereabouts. If you don't know where the other parent is, Arizona allows service by publication after a diligent search, as well as personal service by sheriff or process server. A search takes time, so begin early and ask an attorney about your specific case.

What you don't have to wait for. Arizona waives the home study for stepparent adoption (A.R.S. § 8-105), so there is no home-visit scheduling to hold you up. You also don't need to wait for an attorney appointment, since you can file on your own.

Cost is not a reason to delay. Court filing fees typically run $200-$350, and the total is typically under $1,000. Attorney representation often runs $3,000-$5,000+.

Good things to gather now:

  • Your marriage certificate and the child's birth certificate. If the child was born in Arizona, certified copies come from the Arizona Office of Vital Records.
  • Contact information for the other parent, if known.
  • Your spouse's agreement to go forward.

If you're unsure, start anyway. Starting the paperwork doesn't commit you to anything you aren't ready for, and it helps you see what your situation requires. Your child gains legal certainty, and you gain legal parental rights, once the adoption is finalized.
