When should I start the stepparent adoption process in Nevada?

You can start the Nevada stepparent adoption process as soon as you are ready, because Nevada has no minimum residency period before you can begin. Under NRS 127D.120(1), there is no waiting time to meet first, so the right time is usually when your family has decided to move forward and you can gather the information you need.

Why waiting rarely helps:

  • No residency clock. Since there is no required residency period, waiting will not make you eligible sooner.
  • The process takes time. Stepparent adoptions in Nevada typically take about 3-6 months, so starting earlier means your family is official earlier.
  • Home study is waived. Under NRS chapter 127D, the home study is waived in Nevada, so you are not waiting on that step.

Timing points worth thinking about before you file:

  • Your child's age. Nevada has a child consent age of 14 (NRS 127D.110(1)(c)). If your child is close to that age, it is worth learning how this provision applies to your family. The District Court clerk can help.
  • The other parent. If the other birth parent is involved and agrees, your path may look different than if that parent is absent or unwilling. Nevada's abandonment period is 6 months (NRS § 128.012), but whether it applies depends on the facts of your situation. In Nevada, termination of parental rights is handled separately, so if your case involves a parent who has not consented, speak with an attorney or the clerk about that specific issue before you plan your timeline.
  • Your paperwork. Birth certificates and other records may take time to gather. The Nevada Office of Vital Records is the agency to contact for vital records, and the District Court clerk in your county can tell you which documents they want to see.
  • Filing costs. The filing fee is set by the court. The clerk in your county can confirm the current amount so you can budget.

Where you file. Stepparent adoptions are filed in the District Court, and Nevada has 17 counties, including those serving Las Vegas, Henderson, Reno, North Las Vegas and Sparks. Each court may have its own forms and procedures, so it helps to prepare for your specific county.

A practical way to think about it: begin when you are ready to answer questions about your family, your child, and the other parent's situation. Preparing the paperwork takes less time than many people expect, and it lets you identify any complicated issues early, such as a parent who may not agree. If something in your situation is contested or uncertain, an attorney can advise you on that piece while you move forward on the rest.
