What is the residency requirement for adoption in Pennsylvania?

Pennsylvania has no minimum residency period for a stepparent adoption. The state sets no required number of months you must have lived in Pennsylvania before you file, so there is no residency waiting clock to meet. The residency provision is 23 Pa.C.S. § 2302.

What this means for you. If you recently moved to Pennsylvania, you are not held back by a set number of months of residence. Which county you file in is a separate question. Pennsylvania has 67 counties, and each has its own Orphans' Court. The clerk in your family's county can confirm where your petition belongs and any local filing details. If your situation is unusual, such as a move between states or parents living in different places, ask the clerk or an attorney about that specific issue.

Adult adoptions. The same approach applies if you are adopting an adult. Pennsylvania's statute says an individual may be adopted "regardless of his age or residence," so there is no residency condition there either. For an adult adoption, venue lies in the county where the parent(s), the adoptee, or the person who filed the report of intention to adopt resides (23 Pa.C.S. § 2302).

Requirements that are separate from residency. Parents often confuse residency with these other steps, so here is how they differ:

  • Consent of the child: A child who is 12 or older must consent to the adoption (23 Pa.C.S. § 2711).
  • Abandonment: When the other parent will not consent, the abandonment period in Pennsylvania is 6 months (23 Pa.C.S. § 2511). Whether it applies depends on your facts, so an attorney or the court clerk can help with a contested situation.
  • Home study: A home study is waived in stepparent adoptions (23 Pa.C.S. § 2531(c); § 2535(a)).

Timeline and cost. Stepparent adoptions in Pennsylvania typically take 3-6 months. Court filing fees run about $200-$500, and the total typical cost is under $550. Hiring an attorney for the whole process often costs $3,000-$5,000+.

Questions families often ask next.

  • If the other parent is paying child support, do you still need their consent? Not necessarily. Support payments do not prevent an abandonment finding if the parent has otherwise failed to maintain meaningful involvement.
  • If the other parent objects, can the adoption still go forward? Pennsylvania courts can still grant the adoption if abandonment is proven, even over an objection. That depends on the facts of your case.
  • What if you cannot locate the other parent? Pennsylvania has procedures for giving notice by publication when a parent cannot be found. For a case like this, speak with the clerk or an attorney.
