To adopt your stepchild in Pennsylvania, you file a petition in the Orphans' Court of your county, get the other legal parent's consent or show that the parent has abandoned the child, and complete the court process, which typically takes 3-6 months. The rules are in Pennsylvania Consolidated Statutes Title 23, Part III.
Where you file. Adoptions are handled by the Orphans' Court in one of Pennsylvania's 67 counties, including those serving Philadelphia, Pittsburgh, Allentown, Reading and Erie. The clerk in your county can tell you about local filing procedures and which county is the right one for your family.
Residency. Pennsylvania has no minimum residency period for this adoption (23 Pa.C.S. § 2302), so you don't have to wait before filing.
Consent and the other parent. Pennsylvania requires the other biological parent's consent to the adoption, along with proper notice to that parent. Some situations come up often:
- The parent objects. If abandonment is proven, Pennsylvania courts can still grant the adoption over the parent's objection. The key is showing a lack of meaningful involvement over time. The abandonment period is 6 months (23 Pa.C.S. § 2511).
- The parent pays child support. Payments don't automatically prevent an abandonment finding. Courts look at the whole relationship, not only financial contributions.
- You can't find the parent. Pennsylvania has procedures for giving notice by publication when a parent cannot be located, and this can support an abandonment case.
Contested cases and unknown-parent cases depend on the specific facts. For those, ask the Orphans' Court clerk or an attorney about your situation.
The child's consent. A child's consent is required at age 12 (23 Pa.C.S. § 2711).
Home study. A home study is waived in stepparent adoptions (23 Pa.C.S. § 2531(c); § 2535(a)), which keeps the process simpler.
Same-sex couples. Pennsylvania recognizes all valid marriages for stepparent adoption purposes, so married same-sex couples can adopt.
Cost. Court filing fees typically run $200-$500, and the total typical cost is under $550 when you handle the filing yourself. Hiring an attorney to handle the whole thing is often $3,000-$5,000+.
Why families do it. Adoption creates a legal parent-child relationship. It also establishes inheritance rights, gives you medical decision-making authority, and provides access to Social Security and insurance benefits. For your child, it brings psychological security and legal protection if something happens to a parent.
Putting it together.
- Confirm whether the other parent will consent or whether abandonment may apply.
- Prepare the petition and supporting paperwork for your county's Orphans' Court.
- File in your county and give the other parent proper notice.
- Ask the clerk about any hearing details or local requirements.
