What if the other parent won't sign consent in Rhode Island?

If the other parent won't sign consent in Rhode Island, your adoption may still be able to move forward in Family Court. Rhode Island has an abandonment provision, R.I. Gen. Laws § 15-7-7, with a six-month period, and it is the main route families look at when a parent is unwilling or unreachable.

How abandonment fits in. The abandonment period in Rhode Island is 6 months. Whether a particular parent's absence meets the standard in § 15-7-7 depends on the facts of your situation, and it is the judge who decides, not you and not us. The Family Court clerk in your county can tell you how the court expects abandonment to be presented. An attorney can tell you whether your facts fit.

No separate termination case. Rhode Island does not treat termination of the other parent's rights as a separate proceeding for these cases. It is addressed within the adoption itself, so you do not file a second case before you begin.

When the other parent is involved and objecting. If the other parent is active in the child's life and says no, that is a different situation from a parent who is absent and simply not responding. It is likely to be contested, and a judge will weigh it. For that specific issue, we recommend speaking with a Rhode Island family law attorney. The Family Court clerk can explain the court's procedures, but cannot advise you on strategy.

Other consents still matter. If your child is 14 or older, the child's own consent is required under R.I. Gen. Laws § 15-7-5(a). This is separate from the other parent's consent, so plan for it if it applies to your family.

What else to expect:

  • Court: Your petition is filed in Family Court.
  • Home study: Rhode Island waives the home study for stepparent adoptions under R.I. Gen. Laws § 15-7-11.
  • Residency: Rhode Island sets no minimum residency period for you to file.
  • Timeline: Stepparent adoptions in Rhode Island typically take about 3-6 months. A contested case can take longer, and the clerk can tell you how scheduling works in your county.
  • Filing fees: The Family Court clerk in your county can confirm the current amount.

Questions to settle before you file:

  • Do you know where the other parent is, and have you had any recent contact?
  • How long has it been since the other parent had any contact with your child?
  • Has the other parent said they will refuse, or have they just not responded?

Your answers will help you and the clerk or an attorney work out whether you are looking at an uncontested filing, an abandonment situation, or a contested case.
