How do I adopt my stepson or stepdaughter in Rhode Island?

You adopt your stepchild in Rhode Island by filing a petition in Family Court, and the court must approve it. The law is in Rhode Island General Laws Title 15, Chapter 7, and a stepparent adoption typically takes about 3-6 months.

Where you file: Family Court. Rhode Island has 5 counties, and the Family Court clerk where you live can tell you about local filing procedures and the current filing fee. Families in Providence, Warwick, Cranston, Pawtucket and East Providence use the same statute.

Residency: Rhode Island sets no minimum number of months you must have lived in the state (R.I. Gen. Laws § 15-7-4). The clerk can confirm how this applies to your family.

Your stepchild's consent: If your stepchild is 14 or older, their consent is required (R.I. Gen. Laws § 15-7-5(a)). Below that age, the law does not require the child's own consent.

The other parent: This is often the most important question in a stepparent adoption, and the answer depends on your facts. If the other legal parent does not agree, Rhode Island's abandonment provision uses a six-month period (R.I. Gen. Laws § 15-7-7). Whether it fits your situation, or whether the other parent is unknown or hard to find, is something to raise with the Family Court clerk or an attorney. Contested situations are where individual legal advice matters most.

Home study: It is waived for stepparent adoptions (R.I. Gen. Laws § 15-7-11). You should not have to schedule a social worker's home visit as part of the process.

Timeline: Plan on roughly 3-6 months from filing to finalization. Court schedules vary, so the clerk can tell you what to expect in your county.

After the adoption: For questions about updating your child's birth certificate, contact the Rhode Island Department of Health Office of Vital Records.

Your basic steps:

  • Confirm whether the other parent will consent, and raise any difficulty there with the clerk or an attorney.
  • Prepare the petition and supporting documents for your county's Family Court.
  • If your stepchild is 14 or older, make sure their consent is included.
  • File with the Family Court clerk, then attend the hearing the court sets.

Adopting an adult stepchild: If your stepchild is 18 or older, the process is different. The petition goes to the probate court of your city or town rather than Family Court. Local probate courts may have their own rules, so check with the probate clerk first. Timelines are often shorter, about 4-8 weeks.
