How old do you have to be to adopt in Rhode Island?

Rhode Island does not set a specific minimum age for the person adopting. For a child under 18, the statute only requires that the adopter be older than the child, and it gives no number of years (R.I. Gen. Laws § 15-7-4).

Adopter's age. The law describes the child as a person younger than the adopter and under 18. It does not say the adopter must be 21, 25, or any other particular age. It also does not require a set number of years between the adopter and the child. If your situation involves an unusually small age difference, the Family Court clerk in your county can tell you how the court looks at it.

The child's age matters too. In Rhode Island, an adoption cannot go forward without the consent of a child who is 14 or older (R.I. Gen. Laws § 15-7-5(a)). For a younger child, that consent rule does not apply.

Adopting someone 18 or older. Rhode Island's statute is silent on who is eligible to be adopted as an adult, and it says nothing about an age gap for adult adoptions. A petition to adopt someone who is 18 or older goes to the probate court of the city or town where the petitioners live, not to Family Court. Because the statute does not address eligibility rules for adults, check the details with that probate court's clerk or an attorney.

Where a stepparent adoption of a minor is filed. A stepparent adoption of a child under 18 is filed in Family Court. Rhode Island has 5 counties, and the court clerk can confirm local filing procedures and the current filing fee.

Other points that may help you plan:

  • Rhode Island has no minimum residency period for filing.
  • A home study is waived in stepparent adoptions (R.I. Gen. Laws § 15-7-11).
  • Stepparent adoptions in Rhode Island typically take about 3-6 months.
  • Adult adoptions typically take about 4-8 weeks.

When to get individual help. If the other biological parent is unknown, contests the adoption, or hasn't been involved, the outcome depends on your specific facts. The Family Court clerk or a Rhode Island attorney can answer questions about your own situation.
