Rhode Island adoption law is found in Rhode Island General Laws Title 15, Chapter 7, and a stepparent adoption of a child is filed in the Family Court. The rules below are the main ones for stepparents.
Where you file: Family Court handles adoptions of minor children in Rhode Island. The state has five counties, and our documents are prepared for the county where you file. Adoptions of adults are different: they go to the probate court of the city or town where the petitioners live.
Residency: Rhode Island sets no minimum number of months you must have lived in the state before filing. Residence in Rhode Island is still part of the petition requirements under R.I. Gen. Laws § 15-7-4, so the clerk can confirm how it applies to you.
Consent of the child: A child who is 14 or older must consent to the adoption under R.I. Gen. Laws § 15-7-5(a). For a younger child, the child's own consent is not part of this rule.
Abandonment: Rhode Island's abandonment period is 6 months under R.I. Gen. Laws § 15-7-7. Whether it applies to your family depends on your facts. If the other biological parent will not consent, cannot be found, or you think abandonment may be an issue, ask the Family Court clerk or an attorney about that specific situation.
Home study: Rhode Island waives the home study in stepparent adoptions under R.I. Gen. Laws § 15-7-11, so you do not need to schedule a social worker visit for this type of case.
Termination of the other parent's rights: Rhode Island does not treat termination as a separate court case in a stepparent adoption. The question is handled within the adoption itself. How it works in a particular family depends on the facts, so check with the clerk or an attorney.
Timeline: A stepparent adoption of a child in Rhode Island typically takes 3-6 months. An adult adoption typically takes 4-8 weeks.
Adult adoption: Adult adoption is permitted in Rhode Island. The statute does not spell out detailed eligibility rules for adults, and probate courts may have their own local rules. Confirm those with the probate court in your city or town, such as Providence, Warwick, Cranston, Pawtucket or East Providence, or with an attorney.
Fees and records: The filing fee is set by the court, and the Family Court clerk in your county can tell you the current amount. After the adoption is final, the Rhode Island Department of Health Office of Vital Records is the agency to contact about birth records.
Questions the statute may not answer for you: Situations such as an unknown parent, a contested case, or special circumstances turn on specific facts. For those, the Family Court clerk or an attorney is the right person to ask.
