What if the biological parent lives in another state — can I still adopt in Arizona?

Yes, in most cases. The other parent living in another state does not stop you from adopting your stepchild in Arizona. What matters most is that you, the adopting stepparent, are an Arizona resident. The case is filed in an Arizona Superior Court.

Your residency is the key point. Adopting a child in Arizona requires that you be an Arizona resident, and A.R.S. § 8-103 sets no minimum period of residency. You don't have to wait a set number of months after moving here. Nonresidents qualify only in a narrow situation involving a dependent child. If that might be you, check with the Superior Court clerk or an attorney.

Reaching a parent in another state. Arizona allows these methods of service:

  • Personal service by a sheriff or a process server
  • Service by publication if the parent's location is unknown, after diligent efforts to find them

How these steps work when the parent lives outside Arizona depends on the details. The Superior Court clerk in your county can confirm the exact requirements, including where to file.

Consent or ending parental rights. An Arizona stepparent adoption packet includes either consent forms from the other biological parent or a motion to sever that parent's rights. Termination is handled as a separate step from the adoption itself. If the parent agrees, the paperwork is usually simpler. If the parent is uncooperative or can't be found, the process depends on your facts.

The abandonment question. Some families in this situation wonder whether a parent who lives far away and has been out of contact counts as having abandoned the child. Arizona's abandonment provisions use a six-month period (A.R.S. §§ 8-531(1), 8-533(B)(1)). Whether your situation meets that standard depends on the specific facts, such as contact and support. That is a question for an attorney or the court clerk, especially if the other parent might contest the adoption.

Time and cost. A stepparent adoption in Arizona typically takes 4-8 months. Court filing fees generally run $200-$350, and the total typical cost is under $1,000, compared with $3,000-$5,000+ when hiring an attorney. Serving a parent out of state may add some effort, but the clerk can tell you about any local fees.

Other Arizona requirements. Whatever the other parent's location, the petition is filed with the Superior Court. Arizona also requires fingerprint clearance for adoption petitioners, and your spouse, the child's parent, must consent to the adoption.
