What happens if I start the adoption in Arizona and then we move?

If you move during the adoption process, here are your options:

Option 1: Continue in Arizona

  • If the petition has already been filed with the Superior Court, the case can typically continue in that court
  • You may need to arrange to attend the finalization hearing (in person or virtually)
  • Some courts allow telephonic or video appearances for parties who have moved

Option 2: Transfer or refile in the new state

  • If you move before filing, file in the new state instead
  • If you move early in the process, it may make sense to withdraw and refile in the new state
  • You will need to meet the new state's residency requirement
  • We can prepare new documents for the new state at no additional charge (if before filing) or for a minimal revision fee

Factors to consider:

  • How far along is the case? (If nearly done, finish in Arizona)
  • Can you attend the Arizona hearing? (Virtual options may be available)
  • Does the new state have a shorter or longer residency requirement?
  • Is the biological parent already served? (Restarting service adds time)

Military families:

  • PCS moves during adoption are common
  • Many courts accommodate military families with virtual hearings
  • SCRA protections may apply

Our advice: Start now regardless of potential moves. If plans change, we adapt your documents.
